This Personal Data Protection Policy is issued
by KhaiLing Yau Chambers (“KLYC”, “us”, “we” and “our”)
as we are strongly committed to protect the security and confidentiality of
your personal data and information. In line with the Personal Data Protection
Act 2010 and any regulations enacted thereunder (collectively, the “PDPA”),
this Policy describes how we collect and use the personal data provided by you
through this website. All terms in this Policy shall have the meaning ascribed
to it under the PDPA unless otherwise defined below.
By engaging us to provide services to you, or by accessing and using our website, or by providing your personal data to us, you consent to us using, collecting and processing your personal data in the manner stipulated in this Policy. We will also assume that all personal data provided by you is accurate and complete, and that you shall update us in the event of any change to such personal data.
We reserve the right to change, amend or modify this Policy from time to time without notice. Accordingly, you should read this Policy from time to time in case of any changes. By continuing to use our website or to communicate with us following the changes or amendment, you will be deemed to accept such changes or amendment to this Policy.
1. PERSONAL INFORMATION AND DATA COLLECTION
The types of personal data collected and processed by us may include but not limited to information such as your name, identity card, passport number, age, nationality, date of birth, residential address, contact number, email address and such other relevant information which we may require in order for us to provide you with our services.
Unless stated otherwise in this Policy, it is necessary for our provision of services to you that you supply us with the personal data requested by us. If you fail or choose not to provide us with such data, or do not consent to this Policy, we will not be able to provide you with our services that you have engaged us for. Further, you agree that we shall not be held liable for any of the consequences arising non-provision of your personal data.
In addition to the personal data that you have provided to us directly (whether during engagement of our services or during any communication with us), your personal data may also be collected from variety of available sources, including but not limited to credit reporting agencies, government agencies, public registries, websites, social media, publications, events, conferences, seminars, talks or meetings.
2. PURPOSES FOR COLLECTION AND PROCESSING OF PERSONAL DATA
We collect the personal data provided by you to us for the following purposes:
- the delivery of services or deliverables whether present or future, to you;
- to facilitate payment for our services;
- to maintain and update internal record keeping, files, billing databases and contact lists;
- to manage and maintain our client relationship;
- for KLYC to communicate with you;
- to respond to your complaints, queries and/or requests;
- those purposes specifically provided for in any particular service or product offered by us;
- to comply with or meet any legal or regulatory requirements relating to our provisions of services and to make disclosure under the requirements of any applicable law, regulation, direction, court order, by-law, guideline, circular, code applicable to us;
- to send you information by e-mail, telecommunication means or social media about our services which may be of interest to you;
- to send your personal data as potential referees to editors/researchers in legal ranking publications and journals and potential clients who requests for referees of past work in our credential statements, tenders and submissions;
- for security and internal audit purposes;
- for such other purposes as may be directed or consented to by you; and
- for all other purposes in relation to our business transaction.

3. DISCLOSURE OF PERSONAL DATA
Personal data provided to us will generally be kept confidential except to the following parties under certain circumstances:
- our employees, third party service providers, counterparties or their professional advisers, agents and representatives for the purposes relating to your engagement of our services;
- our auditors, consultants, accountants, insurers, or other professional advisers and the Bar Council;
- any persons to whom we are compelled or required to do so under the requirements of any law, rules, regulations, court order, codes of practice or guidelines binding on us;
- government agencies, law enforcement agencies, courts, tribunals, regulatory bodies, ministries and/or statutory agencies or bodies, offices or municipality in any jurisdiction, if required or authorised to do so;
- foreign governmental authorities in accordance with the laws of the point(s) of departure and/or destination; and
- any persons directed by or consented to by you.
Where we consider it necessary or appropriate for the purposes of processing your personal data or providing any service to you, we may transfer your personal data to such third parties stated in this Policy outside of Malaysia. Accordingly, by engaging us, you expressly consent to us transferring your personal data outside of Malaysia.
4. RETENTION OF PERSONAL DATA
Any of your personal data provided to us is retained for as long as the purposes for which the personal data was collected continues. Your personal data will be then destroyed from our records and system in the event your personal data is no longer required for the said purposes unless further retention is required to satisfy a longer retention period to meet our regulatory or accounting requirements.
5. PERSONAL DATA FROM MINORS AND OTHER INDIVIDUALS
To the extent that you have provided or will provide personal data about your family members, spouse and/or other dependents, you confirm that you have obtained their consent to the processing and using, including disclosure and transfer of their personal data in accordance with this Policy. In respect of minors (i.e individuals under 18 years of age) or individuals who are not legally competent to provide consent, you confirm that they have appointed you to consent on their behalf to the processing and using, including disclosure and transfer of their personal data in accordance with this Policy.
6. RIGHTS OF ACCESS AND CORRECTION
Subject to the exceptions provided under the PDPA, you have the right at any time to request access to and correction and limiting the processing of your personal data held by us. If you wish to do so, please submit your written request to:

In addition, you also have the right, by notice in writing, to inform us on your withdrawal (in full or in part) of your consent given previously to us subject to any applicable legal restrictions and a reasonable duration of time for the withdrawal of consent to be affected.
